Consignor Agreement

ATLANTIC CITY CAR SHOW & AUCTION - CONSIGNOR AGREEMENT

This Agreement is made between the undersigned Consignor and the Atlantic City Car Show & Auction ("Auction Company") for the consignment and potential sale of the vehicle(s) described herein, to be offered at public auction at the Atlantic City Convention Center on the scheduled auction dates of June 11-13, 2026.

  1. Consignment Terms: Consignor agrees to consign the vehicle(s) listed on the attached inventory sheet (or as otherwise submitted in writing) to be offered for sale at the Atlantic City Car Show & Auction. The Auction Company is authorized to market, display, and offer the vehicle(s) for sale at its sole discretion, either live, online, or both.
  2. Commission: The Auction Company shall receive a commission on the final sale price of each consigned vehicle as follows:
    • 10% of the sale amount up to and including $50,000
    • 5% of the sale amount exceeding $50,000
    This commission will be deducted from the gross sale proceeds before payment is made to the Consignor.
  3. Reserve Price: If a reserve (minimum acceptable selling price) is requested by the Consignor, it must be clearly stated in writing at the time of consignment. If no reserve is listed, the vehicle will be considered consigned with no reserve and will sell to the highest bidder.
  4. Buyer Verification and Payment: The Auction Company will make every reasonable effort to verify the identity of the buyer and confirm their financial ability to complete the purchase. However, the Consignor acknowledges that a sale is not deemed final at the fall of the hammer but only upon receipt of cleared funds from the buyer. The Auction Company does not guarantee payment and shall not be held liable for any buyer default or delay in completing the financial terms of the transaction.
  5. Title and Vehicle Release: The Consignor is responsible for providing a clean, transferable title at the time of consignment. All titles must be received and verified prior to the auction, free of any liens unless accompanied by accurate payoff information and lienholder release instructions. Vehicles and titles will not be released to the buyer until all funds have cleared.
  6. Photography and Vehicle Description: The Auction Company may photograph and promote the vehicle(s) using the information provided by the Consignor; however, the Consignor is solely responsible for the accuracy of all representations, including year, make, model, mileage, VIN, trim level, drivetrain, and all mechanical or cosmetic claims. The Consignor agrees to hold harmless the Auction Company from any claims or disputes that arise from inaccurate or misleading information, regardless of whether the Auction Company edited or formatted the listing.
  7. Vehicle Condition and Representation: The Consignor affirms that all representations regarding the condition, originality, modifications, or other characteristics of the vehicle are accurate and truthful to the best of their knowledge. The Consignor assumes full liability for any discrepancies or disputes, including but not limited to odometer readings, title branding, VIN accuracy, and disclosure of defects or damage.
  8. Insurance and Risk of Loss: Consignor agrees to maintain insurance coverage on the vehicle(s) throughout the consignment period. The Auction Company assumes no responsibility for damage, theft, fire, vandalism, or any other loss that may occur while the vehicle is on display, in transit, or in possession of the Auction Company or its contractors.
  9. Transportation and Display: Transportation to and from the auction site is the sole responsibility of the Consignor unless otherwise agreed in writing. Any arrangements made for display setup or logistics must comply with facility and event rules. The Auction Company reserves the right to position and stage the vehicle(s) as it sees fit for optimal presentation.
  10. Unsold Vehicles: If a vehicle does not sell at auction, the Consignor must arrange to have it removed from the Atlantic City Convention Center no later than Monday, June 15, 2026. Vehicles remaining after this date may be subject to storage fees or removal at the Consignor's expense.
  11. No Guarantee of Sale: While the Auction Company will use commercially reasonable efforts to promote and sell the vehicle(s), no guarantee is made regarding sale price, sale timing, or whether a sale will occur.
  12. Withdrawal or Cancellation: Once consigned, the vehicle(s) may not be withdrawn from the auction without prior written approval of the Auction Company. If approval is granted, the Consignor may be responsible for administrative or promotional fees incurred in preparation for the auction.
  13. Legal Compliance: Consignor affirms they have full legal authority to consign and sell the vehicle(s), and that the vehicle(s) are not subject to any undisclosed liens, legal claims, or encumbrances. Consignor agrees to indemnify and hold harmless the Auction Company and its affiliates from any claim, loss, or expense arising from the sale or attempted sale of the consigned vehicle(s).
  14. Entire Agreement: This document constitutes the entire agreement between the parties and supersedes any prior verbal or written statements. Any modifications must be made in writing and signed by both parties.

By signing below, the Consignor agrees to the terms stated above and authorizes the Atlantic City Car Show & Auction to act as their agent in offering the consigned vehicle(s) for sale.
